1. INTRODUCTORY PROVISIONS

1.1. These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) regulate the rights and obligations of the seller and the buyer in connection with purchase agreements concluded through the online store available at www.icypic.com.

1.2. These Terms and Conditions form an integral part of the purchase agreement concluded between the seller and the buyer. The purchase agreement is concluded in the Czech language.

1.3. By submitting an order, the buyer confirms that they have read, understood, and agreed to these Terms and Conditions.

1.4. The seller reserves the right to amend these Terms and Conditions at any time. The version of the Terms and Conditions effective at the time the order is submitted shall apply to each individual purchase agreement.

2. CONCLUSION OF THE PURCHASE AGREEMENT

2.1. Product presentations displayed on the ICYPIC website are for informational purposes only. The seller is not obliged to conclude a purchase agreement regarding any displayed products.

2.2. The buyer places an order through the online order form, which includes in particular:

• specification of the selected product, including any personalization details;
• uploaded or selected photograph(s) provided by the buyer;
• selected payment method;
• delivery method and delivery information;
• total purchase price including shipping costs.

2.3. By submitting the order by clicking the “Complete Order” button, the buyer confirms that the order is binding and acknowledges that ICYPIC products are created specifically according to the buyer’s requirements.

2.4. Acceptance of the order is confirmed to the buyer by email. The purchase agreement is concluded at the moment the buyer receives this order confirmation.

2.5. The seller reserves the right to request additional confirmation of an order, particularly for higher-value orders or where there is a reasonable suspicion of an error in the order details.

3. PRICE AND PAYMENT TERMS

3.1. All prices displayed on the ICYPIC website are final and include applicable taxes unless otherwise stated.

3.2. The buyer may pay for the order using the payment methods available on the ICYPIC website.

3.3. In addition to the product price, the buyer is required to pay applicable shipping costs, unless free shipping is offered.

3.4. Due to the personalized and made-to-order nature of ICYPIC products, payment may be required in advance before production begins.

3.5. An electronic invoice or tax document will be issued and sent to the buyer after payment has been received.

4. PERSONALIZED PRODUCTS, RETURNS AND WITHDRAWAL FROM THE PURCHASE AGREEMENT

4.1. The buyer acknowledges that ICYPIC products are made to order and individually created based on the buyer’s selected photograph, preferences, and personalization requirements.

4.2. Each ICYPIC artwork is a unique customized product created specifically for the buyer. Once an order has been processed and production or personalization has started, the buyer cannot withdraw from the purchase agreement or request a refund due to a change of mind, incorrect image selection, personal preference, or any other reason unrelated to a product defect or damage.

4.3. In accordance with Section 1837 of the Czech Civil Code, the right to withdraw from the purchase agreement does not apply to goods made according to the consumer’s specifications or clearly personalized for the consumer.

4.4. The buyer is responsible for ensuring that the uploaded photograph, selected design, and order details are correct before completing the purchase.

4.5. If the product is lost during transportation or arrives damaged, the seller will provide a replacement print at no additional cost to the buyer.

4.6. For any other reason, personalized ICYPIC products cannot be returned, exchanged, or refunded.

5. SHIPPING AND DELIVERY

5.1. The buyer is obliged to accept the delivered shipment.

5.2. Upon delivery, the buyer should inspect the condition of the package and product. Any visible damage should be reported to the carrier without unnecessary delay and documented.

5.3. ICYPIC products are carefully packaged due to their artistic and fragile nature. Damage caused by improper handling after acceptance of the shipment cannot be considered a product defect.

6. LIABILITY FOR DEFECTS AND CLAIMS

6.1. The seller is responsible for defects in accordance with applicable Czech and European consumer protection legislation.

6.2. Claims may be submitted by email using the contact details provided on the ICYPIC website.

6.3. A claim may be made particularly in cases of:

• manufacturing defects;
• incorrect printing or production errors;
• damage caused during transportation.

6.4. Claims cannot be accepted for defects caused by:

• improper use or handling of the product;
• exposure to moisture, direct sunlight, extreme temperatures, or unsuitable conditions;
• improper cleaning or maintenance.

6.5. Claims will be processed without unnecessary delay and within the legally required period, no later than 30 days unless otherwise agreed with the buyer.

7. OTHER RIGHTS AND OBLIGATIONS

7.1. Ownership of the product transfers to the buyer once the full purchase price has been paid.

7.2. Out-of-court consumer dispute resolution is provided by the Czech Trade Inspection Authority (Česká obchodní inspekce – ČOI).

8. PERSONAL DATA PROTECTION

8.1. Personal data of buyers is processed in accordance with applicable legislation, including the General Data Protection Regulation (GDPR).

9. COOKIES AND MARKETING COMMUNICATIONS

9.1. The ICYPIC online store uses cookies necessary for the proper operation of the website.

9.2. Consent to receive marketing communications may be withdrawn by the buyer at any time.

10. FINAL PROVISIONS

10.1. Legal relationships arising from these Terms and Conditions are governed by the laws of the Czech Republic.

10.2. If any provision of these Terms and Conditions becomes invalid or ineffective, the validity of the remaining provisions shall not be affected.

10.3. Purchase agreements are stored electronically and are not publicly accessible.
