TERMS AND CONDITIONS

1. INTRODUCTORY PROVISIONS
1.1.
These Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the rights and obligations between the seller and the buyer when concluding a purchase agreement through the online store available at www.icypic.com.
1.2.
These Terms and Conditions form an integral part of the purchase agreement. The purchase agreement is concluded in the Czech language.
1.3.
By submitting an order, the buyer confirms that they have read and agree to these Terms and Conditions.
1.4.
The seller reserves the right to amend these Terms and Conditions at any time. The version effective at the time the order is submitted shall apply to the specific order.
2. CONCLUSION OF THE PURCHASE AGREEMENT
2.1.
All product presentations on the e-shop website are for informational purposes only, and the seller is not obliged to conclude a purchase agreement regarding such products.
2.2.
The buyer places an order through the order form, which contains in particular:
- specification of the ordered product (including personalization),
- selected payment method,
- delivery method and delivery details,
- the total order price including shipping costs.
2.3.
By submitting the order by clicking the “Complete Order” button, the buyer confirms that the order is binding.
2.4.
Receipt of the order is confirmed to the buyer by email. At this moment, the purchase agreement is concluded.
2.5.
The seller reserves the right to request additional confirmation of the order, especially for higher-value orders or in the event of suspected errors in the order.
3. PRICE AND PAYMENT TERMS
3.1.
All prices listed on the website are final.
3.2.
The buyer may pay the purchase price using the payment methods offered on the icypic.com website.
3.3.
In addition to the product price, the buyer is also obliged to pay shipping costs.
3.4.
For personalized products, advance payment may be required.
3.5.
The invoice is sent to the buyer electronically after payment has been received.
4. RETURNS AND WITHDRAWAL FROM THE AGREEMENT
4.1.
The buyer acknowledges that products sold on icypic.com are made to order and are often personalized according to the buyer’s requirements.
4.2.
For this reason, once the order has been processed and personalized, it cannot be returned nor can the buyer withdraw from the agreement without stating a reason, in accordance with Section 1837 of the Czech Civil Code.
4.3.
If the product is lost during transport or arrives damaged, the seller shall promptly arrange for a replacement print to be sent at no additional cost to the buyer.
4.4.
For any other reason, personalized orders are non-refundable.
5. SHIPPING AND DELIVERY
5.1.
The buyer is obliged to accept the shipment.
5.2.
Upon receipt of the shipment, the buyer is required to inspect its condition and immediately report and document any damage to the carrier.
5.3.
The products are fragile. Damage caused by improper handling after receipt of the shipment cannot be claimed.
6. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE (COMPLAINTS)
6.1.
The seller is liable for product defects in accordance with applicable legal regulations.
6.2.
The buyer may submit a complaint via the email address provided in the e-shop contact details.
6.3.
Complaints may be submitted particularly in cases of:
- manufacturing defects,
- incorrect printing,
- damage caused during transport.
6.4.
Complaints cannot be made for defects caused by:
- improper use or handling,
- exposure to moisture, direct sunlight, or unsuitable conditions,
- improper cleaning.
6.5.
Complaints shall be resolved without undue delay, no later than within 30 days.
7. OTHER RIGHTS AND OBLIGATIONS
7.1.
Ownership of the product passes to the buyer upon full payment of the purchase price.
7.2.
Out-of-court consumer dispute resolution is provided by the Czech Trade Inspection Authority (ČOI).
8. PERSONAL DATA PROTECTION
8.1.
Buyers’ personal data are processed in accordance with applicable legal regulations and GDPR. Further details are provided in a separate Privacy Policy document.
9. COOKIES AND COMMERCIAL COMMUNICATIONS
9.1.
The e-shop uses cookies necessary for its proper functionality.
9.2.
Consent to receive commercial communications may be withdrawn at any time.
10. FINAL PROVISIONS
10.1.
Legal relations shall be governed by the laws of the Czech Republic.
10.2.
The invalidity of any provision shall not affect the validity of the remaining provisions.
10.3.
Purchase agreements are archived electronically and are not publicly accessible.
